1. General Information
These terms and conditions govern the relationship between Kalakallas OÜ (hereinafter the service provider) and the client when purchasing a guided fishing trip service. The service provider is registered in Estonia. By placing an order, the client confirms that they have read and agreed to these terms.
2. Service Description
The service provider organises fishing trips on Estonian waters (sea, lakes, rivers). The trip price includes fishing equipment and guide service. The exact location, time and content of the trip are agreed with the client during the booking process.
3. Booking and Agreement
Bookings are made via email, phone or the website contact form. The agreement is considered concluded when the service provider has confirmed the booking in writing. The confirmation specifies the trip date, time, location, number of participants and total cost.
4. Prices and Payment
- 1 person – 200 €
- 2 people – 350 €
- 3 adults or family (2 adults + up to 2 children) – 450 €
- 4 or more people – price to be agreed separately
Prices include VAT in accordance with applicable Estonian law. Payment terms (deposit, full payment) are agreed during the booking process. Payment methods are specified on the invoice.
5. Cancellation and Refunds
The client may cancel a booking under the following conditions:
- 1–7 days before the trip — 50% of the paid amount will be refunded.
- Less than 24 hours before the trip — no refund will be made.
Cancellations must be communicated in writing (by email).
6. Right of Withdrawal
In accordance with the Law of Obligations Act §53(4)(12), the 14-day right of withdrawal applicable to distance contracts does not apply to leisure services (including fishing trips) where the date of service is specified in the contract. The client agrees to this upon confirming the booking.
7. Service Provider's Obligations and Liability
The service provider undertakes to ensure the safe organisation of the trip, appropriate equipment and competent guides. The service provider is not responsible for the size or quantity of the catch, as this depends on natural factors.
The service provider's liability is limited to the cost of the service. The service provider is not liable for indirect damages, lost profits or damages to third parties.
8. Force Majeure
The service provider has the right to cancel or postpone a trip in the event of dangerous weather conditions (storm, strong wind, icy roads, etc.), natural disasters or other unforeseen circumstances that prevent safe conduct of the trip. In such cases, the client will be offered a new suitable time or a full refund of the prepayment.
9. Client's Obligations
- The client arrives at the agreed time and place.
- The client follows the guide's instructions and safety rules.
- The client is responsible for their personal belongings.
- Participation under the influence of alcohol or drugs is prohibited.
- Minors may only participate with an adult companion.
10. Personal Data Processing
Kalakallas OÜ processes the client's personal data (name, email, phone) solely for the purpose of providing the service, in accordance with the General Data Protection Regulation (GDPR) and the Personal Data Protection Act. 11. Dispute Resolution
Disputes are resolved through negotiation. If no agreement is reached, the client has the right to contact the Consumer Disputes Committee (komisjon.ee) or Harju County Court. Applicable law is the law of the Republic of Estonia.
12. Changes to Terms
Kalakallas OÜ reserves the right to modify these terms. Changes will be announced on the website. Bookings already made are governed by the terms in effect at the time of booking.
